Without proper working permit and legal immigration status is a felony.

If they crossed the boarder illegally. They broke the law and are criminals. It's that simple.
Work permit doesn't mean citizen. .You are just allowed to work in the US, but if you have broken our laws and committed a crime..You should be detained and deported....
